Yorkton Pharmacy – Terms of Service

Welcome to yorktonpharmacy.ca (“the Site”). These Terms of Service (“Terms”) govern your access to and use of our website and the products and services offered through our online boutique and gift shop by Yorkton Pharmacy (“we,” “us,” or “our”).

Our online store sells boutique, gift, home, snack, and lifestyle products. The online store does not sell prescription medications, pharmacy services, or other pharmacy-related products.

By accessing or purchasing from our Site, you acknowledge that you have read and agree to these Terms and our related policies, including our Privacy Policy and Return & Refund Policy. If you do not agree with these Terms, please do not access, browse, or purchase from our Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your province or territory of residence, to make purchases on this Site.

By using this Site, you represent that the information you provide is accurate, complete, and current, and that you are authorized to use the payment method provided for your purchase.

2. Products and Availability

Product descriptions, images, colours, packaging, and dimensions are provided as accurately as reasonably possible. However, minor variations may occur, particularly with handmade, seasonal, imported, packaged, or screen-displayed products.

We make reasonable efforts to ensure that product descriptions and prices are accurate. If we discover an error in a product description, price, availability, or promotion, we may correct the error and, where appropriate, contact you before completing or fulfilling the order.

If an order is cancelled because of an error or because a product is unavailable, any payment received for the cancelled item will be refunded.

3. Pricing and Payment

All prices are listed in Canadian dollars (CAD). Applicable taxes and shipping charges will be displayed during checkout or otherwise disclosed before you complete your purchase.

We aim to display accurate prices and availability. We will not intentionally advertise a product at a price that cannot be obtained because of undisclosed mandatory fees. Any applicable shipping, handling, customs, or other charges will be disclosed as early as reasonably possible and before the order is submitted. Payment must be made in full at the time of purchase through the accepted payment methods shown at checkout.

Transactions are processed securely through third-party payment gateways. We do not store complete payment card details.

4. Order Acceptance and Cancellation

Submitting an order through the Site is an offer to purchase the selected products. An order confirmation means that we have received your order; it does not necessarily mean that the order has been accepted or shipped.

We reserve the right to refuse, limit, or cancel an order where:

• A product is unavailable.

• There is an error in pricing, description, or availability.

• We suspect fraud or unauthorized activity.

• The order appears to be placed for unlawful resale or in violation of these Terms.

• Shipping information is incomplete or cannot be verified.

• We are unable to process payment.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item or order.

5. Shipping and Delivery

We offer shipping within Canada and may offer shipping to select international destinations. Available destinations, shipping costs, and estimated delivery times are shown at checkout or in our shipping information.

Delivery timelines are estimates only and are not guaranteed unless we expressly state otherwise.

Customers are responsible for providing complete and accurate shipping information. We are not responsible for delays, failed delivery, or additional shipping costs caused by incorrect or incomplete information provided at checkout.

Once an order has been handed to the carrier, shipping delays, loss, or damage may be subject to the carrier’s policies. Please contact us promptly if an order appears delayed, lost, stolen, or damaged so that we can help investigate and determine the appropriate resolution.

Nothing in these Terms limits any rights you may have under applicable consumer-protection law.

For international orders, the customer is responsible for any customs duties, brokerage fees, import taxes, or other charges imposed by the destination country unless we expressly state otherwise.

6. Returns, Refunds, and Exchanges

Our returns, refunds, and exchanges are governed by our Return & Refund Policy, which forms part of these Terms.

Unless otherwise stated in that policy, sale items, food, snacks, edibles, perishables, and other products identified as non-returnable cannot be returned for change of mind or preference.

Nothing in our Return & Refund Policy or these Terms limits rights that cannot legally be excluded, including rights relating to products that are defective, unsafe, misdescribed, or not fit for their intended purpose.

To report a damaged, defective, incorrect, or missing item, please contact us using the details in our Return & Refund Policy. Include your order number and photographs where helpful.

7. Intellectual Property Rights

All content, materials, text, images, logos, product designs, graphics, photographs, and other material on the Site are owned by Yorkton Pharmacy or licensed to us and are protected by applicable copyright, trademark, and other intellectual-property laws.

We do not guarantee that:

To the fullest extent permitted by law, our total liability for a claim relating to a product or order will not exceed the amount paid for the specific product or order giving rise to the claim.

This section does not exclude or limit liability where doing so would be prohibited by law, including liability that cannot legally be excluded for certain consumer rights, personal injury, fraud, or other matters.

12. Chargebacks and Disputes

If you believe there is an issue with an order or payment, please contact us first so we can investigate and try to resolve the matter.

We may provide transaction records, shipment information, delivery information, and communications to a payment processor or financial institution when responding to a disputed transaction.

Submitting a chargeback or payment dispute in bad faith after receiving the goods or after we have provided a reasonable resolution may result in the suspension of the related account or further action permitted by law. We will not treat a legitimate billing dispute or lawful consumer remedy as fraudulent merely because a customer contacts their payment provider.

13. Privacy

Your use of this Site is also governed by our Privacy Policy.

The Privacy Policy explains how we collect, use, disclose, and protect personal information, including information collected through cookies and the Meta Pixel used for Facebook and Instagram advertising.
